maxdrop.io (the "Site", "Service") is owned and operated by FOMO Group OÜ, a private limited company registered in Estonia under registry code 17616828, VAT number EE103038458, with its registered address at Kastani tn 64a, 50410 Tartu, Estonia ("maxdrop", "we", "us", "our"). You can contact us at support@maxdrop.io.
These Terms and Conditions (the "Terms") govern your access to and use of maxdrop.io, including registering an account, adding funds, purchasing and opening mystery boxes, selling won items back to us for account credit, and requesting physical delivery of won items. By creating an account, or by otherwise using the Site, you agree to be bound by these Terms and by our Privacy Policy, AML Policy, Shipping Policy and Cookie Policy, each of which forms part of this agreement. If you do not agree, please do not create an account or use the Site.
You must be at least 18 years old to register an account or use any part of the Service. Creating or using an account if you are under 18 is a breach of these Terms. We may ask you, at any time, to provide documentary proof of your age and identity. If you cannot provide it, or if we reasonably believe an account is or has been used by someone under 18, we may suspend or close the account, and any items won through it may be withheld without any credit or reimbursement.
It is your responsibility to check that using maxdrop is lawful in the country and region you access it from before you register. We do not offer the Service in every market, and we may restrict, geo-block, or refuse to serve specific countries or regions at our discretion. Using the Service from a jurisdiction where it is restricted does not create any right to use it, and we accept no responsibility for a user's decision to circumvent such restrictions.
By registering, you confirm that: you are at least 18 and have the legal capacity to enter into this agreement; the information you provide is accurate and will be kept up to date; you are not using the Service to launder money or finance any unlawful activity; you have not been convicted of financial crime and are not the subject of related criminal proceedings; and you will not attempt to manipulate, exploit, or interfere with the outcome of any box opening.
You are solely responsible for any taxes and fees that may apply to items you win or receive through the Service, including declaring them to the tax authorities in your country of residence where required.
You may hold only one maxdrop account. You are responsible for keeping your login credentials confidential and for all activity that takes place on your account, whether or not you authorized it. If you suspect unauthorized access, contact us immediately at support@maxdrop.io and change your password. We may suspend or close an account, and void pending transactions, where we reasonably suspect: the account holder is under 18; registration information is false, inaccurate, or unverifiable; more than one account is linked to the same person, household, or device; the account is being used fraudulently, abusively, or to manipulate outcomes; or the account is being used in breach of these Terms or applicable law. Where we suspend or close an account for one of these reasons, funds and items connected to the suspected breach may be withheld pending investigation. You can ask us to close your account at any time by emailing support@maxdrop.io from your registered email address.
You add funds to your maxdrop balance using a supported payment method, then use that balance to open one or more mystery boxes. Each box contains a defined pool of possible items at different value tiers; opening a box randomly allocates you one item from that pool, weighted according to the odds we publish for that box before you buy it. Every box opening results in an item being allocated; there is no outcome in which you receive nothing.
The odds for every item in a box are published on the box itself and are visible before you open it. Published odds reflect the probability of each item at the time you open the box; we may adjust box contents or odds for future openings, but we will not alter a draw already in progress.
The price of a box does not guarantee that the item you receive is worth as much as or more than what you paid. Some outcomes will be worth more than the box price, and some will be worth less. By opening a box you accept the risk that the item you receive may be worth less than what you paid.
The item actually received may differ from the one shown on the Site, as images are illustrative only. Images indicate the type of item in a box and may differ in packaging, condition, colour, revision, or minor specification from the item actually allocated and delivered.
Any item value, estimated retail price, or credit amount shown on the Site is indicative only and reflects our assessment at the time of display. Such values may change at any time, including between the moment a box is opened and the moment an item is shipped or converted to credit, and do not guarantee any resale value, replacement value, or particular worth.
Opening a box is a service we perform immediately when you open it. Before you open a box, we ask you to expressly agree that the box is opened immediately and to acknowledge that you thereby lose your right of withdrawal for that purchase. Once a box has been opened, the purchase is final: we do not refund the amount spent on a box, including because you are unhappy with the outcome.
Won items cannot be exchanged or returned for a refund. Instead, you can sell a won item back to us for account credit (Section 5.3). This does not affect your statutory rights if a delivered item is faulty or not as described (see our Shipping Policy).
You can add funds to your balance by the payment methods shown at checkout. All payments are processed in euros (EUR). Any fees charged by your bank, card issuer, or payment provider (for example, currency conversion or foreign transaction fees) are your responsibility. Where prices are shown in another currency, that amount is an approximate conversion for information only.
Funds you add, and credit generated by selling a won item back to us, are held as credits on your account balance. Credits can only be used within maxdrop, including to open boxes and to pay shipping costs. Credits are not money, cannot be withdrawn, and cannot be transferred to another user's account. We do not make cash refunds of credits under any circumstances, except where a refund is required by applicable law.
Once you win an item, you can: (a) sell it back to maxdrop in exchange for credits, at the sell-back rate we display before you confirm the sale, which may be up to 30% lower than the item's displayed value; or (b) request that it be shipped to you, subject to our Shipping Policy. We may periodically review and adjust sell-back rates for specific items to reflect current market value; the rate shown to you at the point of sale is the one that applies.
You must claim a won item, by requesting shipment or selling it back for credits, within 20 days of the date you won it. If you do not claim it within that period, we may cancel the item without any compensation or credit. We will remind you by email before the claim period ends.
Credits are valid for 12 months from the date they were added to your balance (by top-up or sell-back). Credits not used within that period expire and are removed from your balance without any refund. We will notify you by email at least 30 days before credits expire. If your account has had no activity for 12 months, we may treat it as inactive and close it after notifying you at your registered email address.
As part of operating the platform responsibly, we may ask you to verify your identity, typically using a government-issued photo ID and, where relevant, proof of address. This is not optional once requested: we will not complete the affected transaction, including a shipment, and may suspend your account, until verification is provided or the request is withdrawn. Full detail is in our AML Policy.
If you report that a delivered item is damaged, missing, faulty, or not as described, or that a delivery did not arrive, we may ask you to send photographs of the item, its packaging, and the shipping label. If you do not provide them within 14 days of our request, we may treat the report as unsubstantiated and decline the related claim.
You agree not to: use the Service for any unlawful purpose or in a way that causes distress or harm to another user; impersonate maxdrop staff or another person; attempt to access non-public parts of our systems, probe or scan our infrastructure, or otherwise attempt to defeat our security; reverse-engineer, decompile, or otherwise inspect our software; interfere with the Service for other users, including through malware, flooding, or spam; scrape, systematically collect, or compile data from the Site using bots or similar automated means; or use offensive, defamatory, or unlawful material in any username, message, or public-facing field. If we reasonably suspect a breach of this section, we may investigate, and pending that investigation, items or balance connected to the suspected breach may be withheld.
You are responsible for losses and costs we suffer, including reasonable legal costs and claims made against us by third parties, that are caused by your fraud, your deliberate misuse of the Service, or your breach of these Terms. This does not apply to the extent the loss was caused by our own fault.
We may need to suspend or limit the Service for maintenance, at the request of a regulator or competent authority, or due to circumstances outside our reasonable control. Where practical, we will give notice in advance of planned maintenance and will keep you informed of unplanned disruptions. We are not liable for losses arising from a suspension carried out for one of these reasons.
If we discover an error in a displayed price, odds, or account balance, we will correct it, and if a payout was made in error, we may adjust the affected account balance to reflect the correction. If a result is later found to involve manipulation, fraud, or a breach of these Terms, we may reverse or void the affected transaction.
If something goes wrong, contact support@maxdrop.io from your registered email address first. We aim to acknowledge complaints promptly and to give you a reasoned answer within 15 days. If we are unable to resolve your complaint to your satisfaction, you may refer it to the Estonian Consumer Disputes Committee (Tarbijavaidluste komisjon, ttja.ee) or to the consumer dispute resolution body or courts of your own country of residence.
Everything on the Site, including its design, code, box artwork, odds tables, and branding, belongs to maxdrop or its licensors and is protected by applicable intellectual property law. You may use the Site for your own personal, non-commercial use; you may not copy, redistribute, or commercially exploit its content without our written permission.
To the fullest extent permitted by law, the Service is provided "as is," and we do not guarantee it will be uninterrupted or error-free. We are not liable for indirect or unforeseeable losses, or for events genuinely outside our control (such as internet or telecommunications failures, or acts of a government or regulator). Nothing in these Terms limits liability that cannot lawfully be limited, including liability for death or personal injury caused by our negligence, or for fraud, and nothing in these Terms affects your statutory rights as a consumer. Subject to that, our total liability to you arising out of your use of the Service will not exceed the balance held in your account at the time the issue arose.
We may ask questions about any financial transaction on your account, including the source of funds used to add to your balance. If you do not provide information or evidence that satisfies us, we may decline the transaction, suspend your account, or close it. See our AML Policy.
We may update these Terms from time to time, including to reflect changes in the law, our services, or our commercial arrangements. We will post the revised Terms on this page with an updated "last updated" date, and material changes will be flagged to you in your account or by email before they take effect. Continuing to use the Service after a change takes effect means you accept the revised Terms; if you don't agree with a change, you should stop using the Service and may close your account.
If any provision of these Terms is found to be invalid or unenforceable, it will be separated from the rest of the Terms, and the remaining provisions will continue in full force and effect.
These Terms are governed by the laws of the Republic of Estonia. Any dispute arising out of or in connection with these Terms will be subject to the jurisdiction of the Estonian courts. If you are a consumer, this does not deprive you of the protection of the mandatory provisions of the law of your country of residence, and you may also bring proceedings in the courts of that country.
These Terms are available in several languages. To the extent permitted by applicable law, if there is any inconsistency between language versions, the English version prevails.
Questions about these Terms can be sent to support@maxdrop.io or by post to FOMO Group OÜ, Kastani tn 64a, 50410 Tartu, Estonia.
